In order to be eligible for a Victim of Domestic Violence Visa, your first grant of leave to enter or remain in the UK must have been as the partner of a British citizen or a person settled in the UK or a person with refugee leave; and, any subsequent grants of leave to remain in the UK must also be granted on the same basis.

The Victim of Domestic Violence Visa application carries a high evidential threshold to meet for a successful application because any successful decision is based on the Home Office exercising its discretion in your favour. Therefore, in order to prepare a successful application, you will need to obtain the specified evidence required by the Home Office. Such evidence includes:

• GP documents and medical history demonstrating previous events of domestic abuse reported;

• Police reports and/or crime reference reports of events of domestic abuse reported to the police;

• Letter from social services;

• Criminal Convictions or Police Cautions against the Perpetrator;

• Final order in Civil Court such as Non-Molestation or Occupation Order;

• Other relevant court orders; and

• Other appropriate evidence demonstrating the domestic abuse suffered.
