administer the estate of someone who has died, which includes tidying up their affairs and distributing their assets to their beneficiaries such as their children. Before you&#8217;re able to deal with the deceased person&#8217;s assets &#8211; such as their bank accounts &#8211; you&#8217;ll need to obtain legal authority to act. In England, Wales and Northern Ireland this is called a grant of probate; in Scotland it&#8217;s a grant of confirmation.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-67824cf elementor-widget elementor-widget-text-editor\" data-id=\"67824cf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Only certain people can apply for probate to deal with the estate of someone who died. It depends on whether the person who died left a will. A will is a document made by the deceased that follows proper formalities, namely it must be signed and witnessed by two people.\u00a0\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-01f90e2 elementor-widget elementor-widget-heading\" data-id=\"01f90e2\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">If a will exists<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eda0ee0 elementor-widget elementor-widget-text-editor\" data-id=\"eda0ee0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>You can apply for probate if you\u2019re named in the will, or in an update to the will either by a codicil or by revoking the original will and making a new one. These must be original documents, not photocopies.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c8fd6fe elementor-widget elementor-widget-text-editor\" data-id=\"c8fd6fe\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>If you are named in the will and you do not want to be an executor you can give up your legal responsibility and role permanently (also known as \u2018renunciation\u2019) to apply for probate.
